Selectmen Minutes 06/09/2014

The meeting of the Board of Selectmen was called to order by Vice Chairman Dan Spencer with all members in attendance except Mr. Connor.

A public hearing on the application of Michelle James d/b/a Ruthie’s Soda Fountain for a Common Victualler license was read by Mr. Spencer.  Michelle James presented her plans to open a restaurant at 1 Mechanic Street.  She stated her business will specialize in “meals to go”.  She stated she would open six days per week and closed on Monday.  Mr. Mayhew suggested the license allow her to open on Mondays in the event she chooses to expand.  There were no comments from the public.

On a Mayhew/Soter motion, the Board unanimously voted to close the Public Hearing.

On a Mayhew/Martinis motion, the Board unanimously voted to award the Common Victualler License to Michelle James d/b/a Ruthie’s Soda Fountain seven days per week from 9 a.m. to 9 p.m.

A Public Hearing was held on the application of Danielle Hafers d/b/a Cash for Gold for Second Hand Dealer’s License at 316 Hartford Avenue.  Mrs. Hafers stated her business was primarily on an appointment basis and she has over 20 years of experience in the jewelry business.  Mr. Soter asked if she had reviewed the Town’s Bylaws and if she fully understood the Town’s requirements.  She answered that she fully understood the Bylaw and had met with Police.

On a Soter/Mayhew motion, the Board unanimously voted to close the Public Hearing.

On a Martinis/Mayhew motion, the Board unanimously voted to award the Second Hand Dealer’s License to Danielle Hafers d/b/a Cash for Gold.

A Public Hearing was held on the application of Richard Goldberg d/b/a Marshall’s Jewelers for a Second Hand Dealer’s License at 191 Mechanic Street,

Unit #1.  Mr. Spencer noted that no one from Marshall’s Jewelers was in attendance.

On a Mayhew/Soter motion, the Board unanimously voted to continue the Public Hearing until such time as the applicant arrives or until the Board’s July meeting.

A Public Hearing was held relative to complaints on the Second Hand Dealer’s License of St. Nick’s, 191 Mechanic Street.

Marie Coronato appeared before the Board along with manager Nick Tassone.  Chief Daigle and Detective Provost presented several violations of the Town’s regulations relative to Second Hand Dealers.  Specifically, the owners have been cited on several occasions for failure to document items which they have purchased.

Mrs. Coronato did not dispute the facts but explained these were oversights and not intentional acts.  Mr. Tassone stated it was difficult to document each item when they are small such as a coin collection with many items.

Mr. Spencer stated St. Nick’s was the first establishment to be licensed and should be aware of the requirements.  Mr. Soter stated the licensee needs to take responsibility and fully comply with all aspects of the regulations.

Mr. Martinis asked Mr. Tassome why he did not document a coin collection which was stolen and sold to St. Nick’s.  Mr. Tassone answered there were too many pieces.

Mr. Soter suggested the Board give the licensee one last opportunity to comply and asked Chief Daigle and Detective Provost if they could support such a decision from the Board to which they responded affirmatively.

On a Soter/Mayhew motion, the Board unanimously voted to close the Public Hearing.

On a Soter/Mayhew motion, the Board unanimously voted to officially put St. Nick’s on probation, meaning any future violation will result in a Public Hearing to revoke the license.  The motion does not include any violations which may have occurred prior to this Public Hearing.  Mr. Mayhew encouraged the applicants to contact the Police with any questions.

On a Martinis/Mayhew motion, the Board unanimously voted to abate trash in the amount of $12,663.67, water in the amount of $13,332.70 and sewer in the amount of $375.

On a Soter/Mayhew motion, the Board unanimously voted to approve the May 19th and May 28th minutes.

On a Mayhew/Soter motion, the Board unanimously voted to reappoint Animal Control Officers, Cindy Souza and Tracey Taddeo.

On a Soter/Mayhew motion, the Board unanimously voted to reappoint Town Administrator, Denis Fraine.

On a Soter/Mayhew motion, the Board unanimously voted to reappoint Jay Talerman and the firm of Blatman, Bobrowski and Meade as Town Counsel.

During discussion, Mr. Soter stated that as discussed previously, he and Mr. Connor will be meeting with Department Heads and Boards to review their satisfaction with Town Counsel and to develop a list of areas which need improvement.

On a Mayhew/Soter motion, the Board unanimously voted to appoint Sandra Tracey as a Republican member of the Board of Registrars and Suzanne Garten as a Democratic member of the Board of Registrars.

On a Mayhew/Martinis motion, the Board unanimously voted to appoint Beth Smith to the position of Worker’s Compensation Agent.

On a Martinis/Soter motion, the Board unanimously voted to award the Municipal Buildings Sewer Contract 2014-MBS to the low bidder C.J.P. & Sons Construction Company of Millis all as recommended by the DPW Director on the attached document.

On a Martinis/Soter motion, the Board unanimously voted to reappoint Marguerite Brooks and Eva Marie Gamache to the Council on Aging.

On a Soter/Mayhew motion, the Board unanimously voted to award septic design services for the Bellingham/Hopedale Housing Rehabilitation Program to Marc

N. Nyberg Associates all as recommended by the Office of Community Development Program Manager (attached).

On a Mayhew/Soter motion, the Board was polled with Mr. Martinis, Mr. Spencer, Mr. Soter and Mr. Mayhew voting unanimously to go into Executive Session to discuss contract negotiations relative to tax title property with the Town’s Tax Title Attorney, Pat Costello.  Mr. Spencer stated there would be no statement following the Executive Session.

On a Mayhew/Soter motion, the Board unanimously voted to adjourn the Public Session at 8:20 p.m.
